I thought that to commercially release a song which is someone else itellectual property in this case the lyrics. They need the permission of the owner of the song. In this case Rezner. Is this not the case?

No you just need to obtain a 'Mechanical License' for whatever country you intend to release it in; from MCPS in the UK, and Harry Fox in the US. If you can be bothered registering on the Fox site you can see online how much it would cost you to release your own version of Hurt based on the amount of copies you release.

This is a far better version, and a lot truer to the original sentiment.

I saw in the comments the person who posted that vid on youtube wrote "leona had a rough year last year?"
I just think her label thought it was  a good idea and she did not realise what she was doing

I don't know I haven't heard about that case, but at a guess they possibly wanted to alter the lyrics and/or arrangement, in which case they would need permission.

Here's some info from MCPS/PRS regarding copyright in the UK:

Registering your works with PRS for Music enables you to be correctly paid for the broadcast or performance of your songs".

"Do I need prior approval from the copyright owner to release a cover?

No, provided that you obtain a mechanical licence from MCPS prior to release, a separate prior approval from the copyright owner is not required. If you are to alter any of the arrangement please contact the publisher of the works".

"Arrangements based on copyright material

The copyright owner of the original copyright material must give their permission for the arrangement. Once permission is granted the original copyright owner, not the arranger, will register the arrangement with PRS for Music".

Let's not got get into the irony of what copyrights I've infringed in copying and pasting all that...
