Interesting, but there's a bit more to it than just copying someone's photo.

From the comments section;

Quote
After skimming through the full judgement, it becomes clear that this issue is about commercial use of these pictures: Justin Fielder's image is sold as a poster/ postcard, while the second picture is used on the packaging of English tea, sold to tourists. I can understand that a professional photographer wants to see his creative products protected. The second image is obviously a (bad) case of plagiarism: rather than using the original picture, and paying the original artist royalties, someone at the tea company decided to use a cheap copy and hoped to get away with it.

based on an earlier comment in the Quality Pics thread I was looking through these

Which one came first????

Yet more complicated still:

Quote from: dpreview
...He also took into account the evidence that Mr Houghton was aware of Mr Fielder's image (the two had previously been to court when they had failed to reach a licensing agreement over Houghton's previous infringement of Fielder's copyright), to conclude the similarities were causally related.

Sounds like the accused was taking the piss and thought he'd get away with it.

Does this mean I have grounds to sue Slackers? ;)

Yes, but then a precedent is set for anyone who has taken a similar photo to do the same with you.

Embedding fail

Use the handy buttons above each image to get the BBCode for embedding pictures (see the UKB Wiki for more details).

they should both be prosecuted for public use of the tired cliche that is keeping an object red in an otherwise black and white image

...and I'm pretty sure the settings on my account don't restrict it either (obviously I can see it as its my account).  Perhaps you're not logged in?  :shrug:

Yeah, its a beautiful city cheers.

Spas were great, the highlight was going to a piano concert in the pianists living room.  Two beautiful pieces played (one Beethoven, no idea of the other), drinks & biscuits in the interlude, and you pay what you think is appropriate/can afford.  Highly recommend it to anyone else who goes.
