Using an image without permission
October 02, 2013, 08:06:50 pm
Brief summary

We recently sold our house at auction, the auctioneers were pretty useless and did very little to justify their frankly outrageous fee. The photos they took for web/brochure marketing were bobbins squared so the little lady took a bunch of better shots and we emailed them over with a request to use our better images. Which they did.

Someone bought our house at auction, yay!...
However their situation changed and they decided to immediately put the property back up for auction, and they chose to use the same auctioneers out of convenience I'd guess. Said auctioneers then obviously thought shicka-ding twice the fee for no more work, haul out Mrs At Works snaps and get them boshed in the marketing bumpff. Mrs At Work noticed her photos were being used on the website so sent an email expressing displeasure and her desire that said images be removed from all marketing. All but one of the images have been removed, they are still using an external shot of ours and this is included in the brochure which has now been printed and sent out to their mailing list.

So my wife wants to send them an invoice for the use of the image, which they will almost certainly ignore and we will in all likelihood do nothing further with. But in the interests of wanting to make them possibly do a bit more work to earn their second enormous fee I'm wondering what would be considered a fair amount to try and charge for use of the image.

Any thoughts from the resident papps gratefully received...

Go on any stock image site like alamy and find a random image of a house and see what they'd charge you for web and print use, estimate how many brochures they've printed - then there's your figure.

As above, but add a bit on for the fact that they used it without permission in the first place and for the time you've spent chasing them up. It's likely to be a bargining process so go in high.
